Air Con Energy Inspections

The Requirement

Air conditioning systems can account for 50% of the energy used in a building, and are therefore specifically targeted in the new legislation. Air Conditioning Inspections (ACI) are here to help you comply with this aspect of EPBD and the new Energy Performance of Buildings Regulations. The Charted Institution of Building Service Engineers or CIBSE, have issued a document TM44 which provides the frame-work and guidance for these inspections and their aim is to:

• Provide building owners/operators with information about system performance
• Identify opportunities to reduce your CO2 emissions and save energy and money
• Recommend alternative solutions and technologies for the given building and application.

The output of the inspection will be a report highlighting measures which, if adopted, will have the potential to save energy and money within a reasonable payback period. Inspection reports will remain valid for five years, after which the system will require another inspection.

Which systems require inspection?

As of the 4th January 2011, all air conditioning systems over 12 kW cooling capacity require an ACI. New systems over 12 kW installed after January 2008 must be inspected within 5 years of being put into service
A rule of thumb is that if you have an air conditioned space over 100m2, then in all likelihood you will need an ACI.

An air conditioning system is defined within the regulations as “a combination of all the components required to provide a form of air treatment in which the temperature is controlled or can be lowered, and includes systems which combine such air treatment with the control of ventilation, humidity and air cleanliness”.

Are you compliant?

The implementation dates have now passed so any building that does not possess this certificate is operating outside the law and is non-compliant with current legislation.

From July 2011 it will be mandatory that these inspection reports be lodged with Landmark creating a central register and making the policing of the process a lot simpler.
Trading standards are becoming more proactive and clamping down on non-compliant owners and operators. However, for those owner/operators who are actively involved in the process of undertaking these inspections then no action is being taken.

What Happens if i don’t get an energy inspection done?

Local authorities (usually by their Trading Standards Officers) are responsible for enforcing the requirements relating to air-conditioning inspection reports. Failure to commission, keep, or provide an air-conditioning inspection report when required by the Regulations means you may be issued with a penalty charge notice. Trading Standards Officers may act on complaints or undertake investigations.

They may request you to provide them with a copy of your air-conditioning inspection report. If asked, you must provide this information within seven days of the request or be liable to a penalty charge notice for failing to do so. A copy of an air-conditioning inspection report can be requested by an enforcement officer at any time up to six months after the last day for compliance with the obligation to make it available.
The penalty for failing to having an air-conditioning inspection report is fixed at present at £300 per system per day.
